Terms of service

The agreement between you and Prismly for the use of Prismly. Last updated 21 October 2026.

  1. 01Who we are

Prismly (“we”, “us”) is the operator of this service. prismly.art is a service that generates pictures from written descriptions.

  2. 02Your account

You must be 18 or older to open an account. Keep your password private and your email address current; everything done through your account counts as done by you. One person, one account. The name, phone number and address you enter are kept on your account so you do not have to type them again; only you can see and change them.

  3. 03Credits and how they are spent

Pictures are paid for with credits. Prices are shown on the pricing page before you buy, and the cost of a run is shown before you press the button. Credits do not expire, cannot be transferred to another account and have no cash value except as described in our billing and refund policy. New accounts receive free credits as a gift; we may change or withdraw that gift for new sign-ups at any time.

  4. 04Acceptable use

Do not use the service to create material that is illegal, that sexualises minors, that depicts real people in a misleading or harmful way, that infringes someone else’s rights, or that is meant to harass or deceive. A safety filter may decline a description; we may suspend accounts that keep trying to get around it.

  5. 05Ownership of generated pictures

You own the pictures you generate and may use them for any lawful purpose, including commercially, without crediting us. We store a copy in your account so you can download it again. Because the engine learns from very large collections of images, a result may resemble existing work; checking that your use does not infringe anyone’s rights is your responsibility.

  6. 06Third-party model providers

Pictures are produced by third-party machine-learning models. We may change models, lengths and resolutions as better ones become available. Results vary; we do not promise that a particular description will produce a particular picture.

  7. 07Availability and support

We aim to keep the service available at all times but do not guarantee it. If a run fails, the credits it cost are returned to your balance automatically. Support is by email and we answer within one working day.

  8. 08Liability

To the extent the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect losses such as lost profits. Nothing here limits rights you have as a consumer that cannot be limited by contract.

  9. 09Suspension and termination

You can close your account at any time by emailing info@prismly.art from the address on the account. We may suspend or close an account that breaks these terms. Unused credits on a closed account are handled under the billing and refund policy.

  10. 10Governing law and disputes

These terms are governed by the law of the country where we are established, without affecting the consumer protections of the country you live in. If we cannot settle a complaint together, consumers in the European Union may use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

  11. 11Changes to these terms

We may update these terms; the date at the top shows the latest version. Continuing to use the service after a change means you accept it.

Privacy policy

What personal data we collect, why we hold it, and the rights you have over it. Last updated 21 October 2026.

  1. 01Data we collect

Your email address and a hashed password when you sign up, and the account details you enter — name, phone number and postal address. The descriptions you type and the pictures generated from them. Your orders — pack, amount, date and the payment reference, never your card number. Technical logs such as IP address and browser type, kept for security.

  2. 02Why we process it and on what legal basis

To run your account and deliver the pictures you ask for (performance of our contract with you). To take payments and keep the records tax law requires (legal obligation). To keep the service secure and improve it (our legitimate interest). We do not sell your data or use it for advertising.

  3. 03Prompts and generated pictures

Your descriptions and pictures are stored in your account so you can download them again. They are visible only to you, and to our staff when needed to investigate abuse or a support request.

  4. 04Payment data and our payment providers

Payments are handled by 10xGate and its licensed payment partners. Card and BLIK details are entered on their secure page and go directly to them; they never reach our servers. We receive only the payment reference and its status.

  5. 05Processors and sub-processors

Supabase hosts our database, file storage and sign-in system. Replicate runs the image models; it receives your description to generate the picture and may process it outside the European Union under standard contractual clauses.

  6. 06International transfers

Where a processor handles data outside the European Union, the transfer is covered by the European Commission’s standard contractual clauses or an adequacy decision.

  7. 07How long we keep data

Account data for as long as your account exists. Pictures and descriptions until you delete them or until 12 months after the account is closed. Order records for the period tax law requires, normally seven years.

  8. 08Your rights under the GDPR

You can ask for a copy of your data, have it corrected or deleted, receive it in a portable format, or object to how we use it. Email info@prismly.art and we answer within 30 days. You can also complain to the data protection authority in your country.

Billing and refund policy

How credits are sold, delivered, and refunded. Last updated 21 October 2026.

  1. 01Prices and currency

Packs are priced in euro and include VAT where it applies. Card payments are charged in euro. BLIK payments are charged in Polish złoty, converted at the rate shown at checkout; your bank may apply its own rate or fee.

  2. 02How credits are delivered

Credits are added to your account the moment our payment provider confirms the payment, usually within seconds. If they have not appeared after ten minutes, email info@prismly.art with your order number.

  3. 03The 14-day right of withdrawal and how it is waived

Credits are digital content delivered immediately. At checkout you ask us to deliver them straight away and acknowledge that, once delivery starts, you lose the statutory 14-day right of withdrawal. We still offer the goodwill refund below.

  4. 04Refunds for unused credits

If you have not spent any credit from a pack, you can ask for a full refund of that pack within 14 days of buying it. Packs that have been partly used are not refundable, except where a fault on our side made the credits unusable.

  5. 05Failed generations

When a run fails, its credits are returned to your balance automatically. We refund in credits, not money, because the pack itself was delivered as ordered.

  6. 06Chargebacks and disputes

Please write to us before asking your bank to reverse a payment — almost everything is settled the same day. Accounts with an open chargeback are paused until it is resolved.

  7. 07How to request a refund

Email info@prismly.art from your account address with the order number. Refunds go back to the card or BLIK account that paid, normally within 5–10 business days.
